Welcome to ClientWarehouse.com (“Website,” “Platform,” or “Service”), owned and operated by Get A Claim LLC (“Company,” “We,” “Us,” or “Our”). By accessing, browsing, or using this Platform, you agree to comply with and be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, please refrain from accessing or using the Platform.
1. Acceptance of Terms
By accessing or using ClientWarehouse.com, you confirm that:
• You are at least 18 years of age and have the legal capacity to enter into this agreement.
• You have read, understood, and agree to comply with these Terms and any additional policies, including our Privacy Policy, incorporated herein by reference.
2. Service Description
• ClientWarehouse.com operates as a professional lead marketplace connecting users with verified attorney leads (“Leads”), which may include basic contact details, recorded audio files, PDFs, and other supporting documents.
• Leads are uploaded, managed, and maintained solely by the Platform Admin.
• Users may purchase access to Leads for professional purposes only, subject to these Terms.
3. Account Registration and VerificationTo access the Platform and Leads:
• You must register an account and provide accurate, current, and complete business and contact information.
• Account verification is required for full access. Verification involves an Admin review of your business credentials.
• The Admin reserves the right to approve, deny, or suspend any account at its sole discretion without obligation to disclose reasons.
Account Security:
You are responsible for safeguarding your account credentials. Any unauthorized activity on your account must be reported immediately. We are not liable for unauthorized access caused by your failure to protect login information.
4. Permitted Use of the PlatformUsers agree to:
• Use the Platform and purchased Leads solely for lawful professional purposes related to their business.
• Maintain the confidentiality of purchased Leads. Leads must not be shared, resold, sublicensed, or otherwise distributed without explicit written permission from the Company.
• Adhere to applicable local, state, and federal laws in using the Platform.Prohibited Actions Include, but Are Not Limited To:
• Misrepresenting your business identity or credentials.
• Circumventing payment processes or attempting unauthorized access to the Platform.
• Uploading, sharing, or using Leads for illegal purposes.
• Engaging in fraudulent activities, automated scraping, hacking, or attempts to exploit Platform vulnerabilities.
5. Payment Terms and Refund Policy
• General Refund Policy:
All purchases made on ClientWarehouse.com are final and non-refundable, except as specified below or under exceptional circumstances at the discretion of the Customer Support team. Refunds, when granted, may be partial or full based on the specific details of the case.
• Refunds for the Buy Now Feature:
Purchases made using the Buy Now button may be eligible for a refund under the following conditions:
1. Refund Window: Users may request a refund within 14 days of the purchase date. Refund requests submitted after 14 days are subject to the sole discretion of the Customer Support team.
2. Reason for Refund:
• Refund requests must include specific details as to why the refund is being sought.
• A refund request due to the inability to contact the client is understandable; however, users acknowledge that it is their responsibility to contact the client as soon as possible after the purchase or after accessing the client’s information via the Buy Later feature.
• The Buy Later feature does not provide flexibility for contacting the client at the user’s convenience; it only extends the payment period. Prompt contact with the client is essential to ensure the case’s viability, as delays may make it more difficult to reach the client.
• If a user requests a refund due to the inability to make contact, ClientWarehouse.com will attempt to contact the client to reinvigorate interest in the case. Refunds for this reason are not guaranteed, as our primary role is to facilitate the initial connection.
3. Unsuccessful Cases: Refunds may be granted in cases where the lead proves unsuccessful, but these are evaluated on a case-by-case basis. Refunds for unsuccessful cases may be partial or full, depending on the specific circumstances.
• Refunds for the Buy Later Feature:
The Buy Later feature allows users to reserve and complete a purchase at their discretion. Users acknowledge the following:
1. Purpose of the Feature:
• The Buy Later feature is designed to give users additional time to pay for a card. By using this feature, users are still agreeing to the purchase and are obligated to pay for the card once they decide to complete the purchase.
2. Cancellation Requests:
• Cancellation requests for a reserved card are only allowed before the purchase is finalized. Users may request a cancellation if they determine the case is not viable during the reservation period.
• If a cancellation request is made, partial payment may still be required, as the client’s contact information has already been provided to the user, and the card is no longer usable on the marketplace.
• The Customer Support team will review cancellation requests and may contact the client to ensure all efforts have been made to assist with the case. If it is determined that the case is truly not viable, the user may not be required to pay a partial amount for the client card.
3. Misuse of the Feature:
• Users who frequently request cancellations for reserved cards risk abuse of the feature. Such behavior may result in temporary or permanent account suspension, as determined by the Admin team.
4. User Responsibility:
• By using the Buy Later feature, users take full responsibility for promptly contacting the client to evaluate the potential of the case. Delaying client contact reduces the likelihood of success and is strongly discouraged.
• Discretionary Refunds:
Refund requests outside the specified conditions above will be reviewed by the Customer Support team on a case-by-case basis. Refunds granted at the team’s discretion may be partial or full, depending on the circumstances.
• Feature-Specific Terms:
Certain features or functionalities of the Platform may have additional terms and conditions regarding refund-ability. These terms will be presented to users at the time of use (e.g., via a pop-up). By agreeing to such terms, users acknowledge that these terms supplement or take precedence over the general refund policy.
6. Lead Access and Limitations
• Users can preview up to three Leads without immediate purchase to evaluate their value.
• Premium Leads, designated with a special marker, may have separate pricing and discount policies that supersede general access terms.
• Access to Leads is granted only to the purchasing user or entity and must remain confidential. Unauthorized sharing of Leads is strictly prohibited.
7. Intellectual Property
• All content on ClientWarehouse.com—including text, graphics, logos, audio files, lead formats, and other proprietary materials—is the exclusive property of Get A Claim LLC or its licensors and is protected under copyright, trademark, and other intellectual property laws.
• Users are granted a limited, revocable, non-exclusive license to access and use Leads solely for professional purposes as defined in these Terms.Unauthorized reproduction, modification, or resale of content may result in legal action.
8. Ownership Changes and Liability LimitationsYou acknowledge and agree that:
• ClientWarehouse.com and its operations may, at any time, be sold, transferred, or assigned to a new owner or entity. In the event of such ownership changes, these Terms will remain binding on all users.
• You waive all rights to bring legal claims, lawsuits, or demands against ClientWarehouse.com, its current or future owners, its parent company (Get A Claim LLC), affiliates, subsidiaries, or any associated companies, regardless of any changes in ownership or management.
9. Legal Jurisdiction and Multi-State Operations
• ClientWarehouse.com operates across all 50 states within the United States. Users are responsible for ensuring compliance with state-specific laws and regulations applicable to their use of the Platform and purchased Leads.
• Governing Law: This agreement will be governed by the laws of the State of Florida, without regard to conflict of law principles.
• Jurisdiction: Any disputes shall be resolved exclusively in the state or federal courts of Clearwater, Florida.
10. Mandatory Arbitration and Limitation of Legal Action
a. Arbitration Agreement
You agree that any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or the purchase of Leads shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
• Arbitration shall occur in Clearwater, Florida.
• Each party shall bear its own legal fees and arbitration costs unless otherwise awarded by the arbitrator.
• Arbitration is the sole and exclusive remedy for disputes, and you waive your right to bring legal action in any court, except to enforce an arbitration award.
b. No Class Actions
You agree that any arbitration or legal proceeding shall be conducted individually and not as part of a class action or consolidated claim.
c. Frivolous Claims
If an arbitrator or court determines that a claim brought against ClientWarehouse.com, its owners (current or future), or associated companies is frivolous or filed in bad faith, you agree to reimburse the Company for all reasonable legal fees, arbitration costs, and expenses incurred, up to a maximum of $100,000.
11. Disclaimers
To the fullest extent permitted by law:
• Leads are provided “as is” and “as available” without warranties of any kind. We make no guarantees regarding the accuracy, reliability, or completeness of the Leads.
• We do not warrant that the Platform will operate uninterrupted, securely, or error-free.
12. Limitation of Liability
To the maximum extent permitted by law:
• Get A Claim LLC and its affiliates, owners, and successors shall not be liable for any damages (direct, indirect, incidental, consequential, or punitive) arising from:
• Use of the Platform or purchased Leads.
• Inaccuracies or omissions in any Leads.
• Our total liability shall not exceed the amount paid for the Leads in question.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting on the Website. Your continued use of the Platform constitutes acceptance of the updated Terms.
